PUBLIC NOTICE Noncompliance with Industrial Pretreatment Standards Under delegation from the Florida Department of Environmental Protection, as defined in Chapter 62-625 FAC, the Emerald Coast Utilities Authority has been given the responsibility for applying and enforcing national pretreatment standards for industrial users in their service area. Pursuant to the requirements of the State Pretreatment Program, the Emerald Coast Utilities Authority must publish, at a minimum, an annual list of the industrial users within its service area that have been in significant noncompliance (SNC) with pretreatment standards or requirements at any time during the previous 12 months. The Code of Federal Regulations has defined SNC for the purpose of public notification. An industrial user is in SNC if its violation meets one or more of the following criteria: 1. Chronic violations of wastewater discharge limits, defined here as those in which sixty-six(66%) percent or more of all the measurements taken for the same pollutant parameter during a six (6) month period exceed a numeric Pretreatment Standard or Requirement, including Instantaneous Limits; 2. Technical Review Criteria (TRC) violations, defined here as those in which thirty three-(33%) percent or more of wastewater measurements taken for each pollutant parameter during a six (6) month period equals or exceeds the product of the numeric Pretreatment Standard or Requirement including Instantaneous Limits, multiplied by the applicable criteria, which in most cases is 1.2; 3. Any other violation of a Pretreatment Standard or Requirement as defined by Section 26-2 that ECUA determines has caused, alone or in combination with other discharges, interference or pass through, including endangering the health of POTW personnel or the general public; 4. Any discharge of a pollutant that has resulted in imminent endangerment to the public or to the environment, or has caused ECUAs exercise of its emergency authority to halt or prevent such a discharge; 5. Failure to meet, within ninety (90) days after the schedule date, a compliance schedule milestone contained in an industrial discharge permit or enforcement order; 6. Failure to provide, within 45 days after the due date, any required reports; 7. Failure to accurately report noncompliance, or 8. Any other violation which the ECUA determines will adversely affect the operation or implementation of the local pretreatment program. PERIOD COVERED BY THIS NOTICE: January 1, 2025 through December 31, 2025 TYPE OF VIOLATION: Violation of Pretreatment Standard (VPS) Violation of Pretreatment Standard TRC Level (VPST) Failure to Meet Permit Condition (FMPC) Failure to Sample (FS) Failure to Report Self-Monitoring (FRSM) Failure to Report Self-Monitoring (>30/45 days late) (FRSM30/45) COMPANY NAMES: 1. Baptist Health Care, Inc. (VPS)(VPST), The silver limit of 0.011 mg/L was exceeded on a single sample with a result of 0.027 mg/L. This limit violation also violated the TRC SNC criteria in the third and fourth rolling 6-month evaluation periods and the Chronic SNC criteria in the third rolling 6-month evaluation period. Adjustments were made to cooling tower treatment and the source of the silver exceedance was confirmed to be corrected with a second sample result of 0.0096 mg/L, well below the discharge limit. 2. V.T. Mobile Aerospace Engineering (ST. Engineering) (FS), Samples were not collected during the July 1, 2025 to December 31, 2025 monitoring period. Since samples were not collected, a Self-Monitoring Report could not be submitted for this monitoring period. 3. Sacred Heart Hospital (FS)/(FRSM), Failure to provide required semi-annual Self-Monitoring Reports within 45 days of the due dates for the first and second half 2025 reporting periods. 4. Escambia County Solid Waste Services Perdido Landfill (FMPC)/(VPS)/(FRSM30/45), Failure to record daily discharge flow reading. Exceeded the permitted daily discharge flow limit in December 2025. Failure to provide required semi-annual Self-Monitoring Reports within 45 days of the due dates. 5. Escambia County Solid Waste Services Palafox Transfer Station (FRSM30/45), Failure to provide required semi-annual Self-Monitoring Reports within 45 days of the due date for the second half 2025 reporting period. 6. US-EPA Gulf Ecology Division Lab (FRSM30/45) Failure to provide required quarterly Self-Monitoring Reports within 45 days of the due dates for the first, second, and third quarters. 4/3/26 #12223980
